Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mapsi API platform and related services ("Service") operated by AlgoLayer Technologies Private Limited ("we", "us", "Company"). By creating an account or using the API, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Mapsi provides geospatial API services including geocoding, routing, maps, and spatial analysis. We offer Free and paid subscription plans as described on our pricing page. Features and limits are subject to change with reasonable notice.

2. Account Registration & Publicity

You must provide accurate information when creating an account. You are responsible for keeping your API keys confidential and for all usage under your account. Notify us immediately if you suspect unauthorised access.

Publicity: For customers on paid plans, you grant us a non-exclusive, royalty-free licence to use your company name and logo on our website and marketing materials solely to identify you as a Mapsi customer. You may opt out of this at any time by emailing legal@mapsi.dev. This clause does not apply to Free plan users.

3. Acceptable Use & Commercial Use

You agree not to use the Service to:

• Violate any applicable Indian or international law
• Track, surveil, or locate individuals without their knowledge or consent
• Reverse-engineer, scrape, or resell the underlying map data in raw form
• Circumvent rate limits or billing controls via proxies or multiple free accounts
• Transmit malicious code or attempt to compromise our infrastructure

Commercial Use: The Free tier is intended for personal projects, academic research, and pre-production testing. Any use within a revenue-generating application, internal company tool, or enterprise environment requires a paid subscription — unless your application generates less than $1,000,000 USD in annual revenue, in which case the Free tier may be used at your discretion pending upgrade as your usage grows.

4. Attribution (Free Plan)

Free plan users must display a visible "Powered by Mapsi" attribution wherever map or geocoding results are displayed. Paid plans from Hobby tier and above do not require attribution.

5. Caching Policy

To ensure data freshness and protect our intellectual property:

• Free Tier: You may cache API responses for up to 48 hours for performance purposes.
• Paid Tiers: You may cache API responses for the duration of your active subscription.
• Permanent Storage: You are permitted to store geocoding results (coordinates and addresses) permanently in your own database. However, you may not sublicense, resell, or redistribute stored geocoding results to third parties.
• Map Tiles: Server-side caching or bulk downloading of map tiles is strictly prohibited.

6. Payments & Refunds

Paid plans are billed monthly in advance. Payments are processed by Razorpay or Dodo Payments. Subscriptions auto-renew unless cancelled before the billing date. Top-up credits are non-refundable once purchased.

We do not offer pro-rata refunds for unused time if you cancel mid-cycle. You retain access until the end of the paid period. Genuine billing errors or duplicate charges will be reviewed and resolved within 7 business days.

7. API Data & Intellectual Property

The underlying map data is derived from OpenStreetMap (© OpenStreetMap contributors, ODbL) and other open datasets. Your right to use API responses is subject to these upstream licences. Mapsi's software, infrastructure, branding, and documentation are owned by AlgoLayer Technologies Private Limited. Nothing in these Terms transfers any IP ownership to you.

You retain all rights to data you submit via API calls (coordinates, addresses). We do not claim ownership of your input data.

8. Uptime & SLA

We are committed to keeping Mapsi reliable and fast. While we do not offer a formal SLA below the Enterprise plan, we monitor the service continuously and treat downtime as a priority incident. We are not liable for losses arising from service interruptions, latency, or data inaccuracies.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law, AlgoLayer Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, business, or goodwill.

Our total cumulative liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim, or ₹5,000 (whichever is lower) for Free plan users.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind. Geocoding, routing, and spatial data may contain errors; do not rely on it for safety-critical applications.

11. Indemnification

You agree to indemnify and hold harmless AlgoLayer Technologies Private Limited, its founders, employees, and agents from any claims, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access for violations of these Terms, non-payment, or for technical or business reasons, with or without notice at our discretion. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms. Material changes will be communicated by email or site notice at least 14 days before taking effect. Continued use after that date constitutes acceptance.

14. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India. Before initiating legal proceedings, parties agree to attempt good-faith resolution via email for at least 30 days.
